OVERVIEW & EXPERIENCE
Ms. Gainey’s civil litigation defense practice includes the representation of clients in premises liability, labor and employment, civil rights, bodily injury, wrongful death and casualty suits and commercial litigation in federal and state courts all over Florida. Her labor and employment experience concentrates on matters relating to employment discrimination, sexual harassment, retaliation, and civil rights violations. Ms. Gainey has presented on various aspects of the law at conferences and to groups. She has also authored numerous articles.

- Whistleblower action against city filed by former project manager; dismissed by the circuit court on motion to dismiss. Castro v. City of Deltona, Case No. 2025-11570-CIDL (2025)
- Malicious prosecution claim filed against police officers; dismissed by the circuit court on a motion for summary judgment. Crews v. Caristo and Ward, Case No. 50-2021-CA-002235 (2025)
- Quiet title and negligence action against the county dismissed by the circuit court on motion to dismiss. Parks v. Brevard County, Case No. 02-2024-CA-030148 (2025)
- Represented a small business owner in a dispute over worker’s compensation coverage in a jury trial where secured verdict for the business owner in the amount of $1.5 million. Grubb v. United Farm Family, State of Indiana (2015)
- Represented McDonald’s franchise in a sex discrimination and negligent hiring case, successful settlement after partial motion for summary judgment. Luttrull v. MAAC, Inc. USDC, Southern District Indiana (2007)
- Represented police department and city in tort claims, invasion of privacy, false imprisonment case, motion for summary judgment granted. Brown v. City of Loogootee, State of Indiana (2007)
