OVERVIEW & EXPERIENCE
Ms. Gainey’s civil litigation defense practice includes the representation of clients in premises liability, labor and employment, civil rights, bodily injury, wrongful death and casualty suits and commercial litigation in federal and state courts all over Florida. Her labor and employment experience concentrates on matters relating to employment discrimination, sexual harassment, retaliation, and civil rights violations. Ms. Gainey has presented on various aspects of the law at conferences and to groups. She has also authored numerous articles.

- Represented apartment complex in a negligent security wrongful death case, settlement after successful motions, Nezius v. BH Management, State of Florida (2021).
- Represented major apartment and management company in South Florida on various premises liability cases, State of Florida (2019-2021).
- Represented a small business owner in a dispute over worker’s compensation coverage in a jury trial where secured verdict for business owner in the amount of $1.5 million. Grubb v. United Farm Family, State of Indiana (2015).
- Represented manufacturer in a products liability case, motion for summary judgment granted, Haimbaugh v. Game Tracker, State of Indiana, (2009).
- Represented a movie theatre in a negligent security wrongful death case, motion for summary judgement granted, Luke v. United Artists Theatre Group, Inc., State of Indiana (2007).
